Surcharging & Cash Discounting

A perennially moving target, the surcharging landscape has been anything but stagnant in 2026. The last year has seen the approval of a settlement in the decades-long Visa and Mastercard class action litigation which has affected surcharging practices at the card brand level. The state law front has seen a number of new laws restricting the assessment of so-called “junk fees,” and even prohibiting the assessment of fees on debit cards— drawing into question cash discounting practices. Come hear the latest twists and turns in the complex compliance area of charging a different price based on how the consumer pays.

Payment Facilitator Risk: Structure, Liability, and Exposure

Payment facilitators, in their various iterations, remain in one of the most scrutinized corners of the payments ecosystem. This workshop will focus on the practical conversation on key issues impacting PayFacs including: structural variations on the PayFac model; key contracting and liability issues with sponsors, processors, and sub merchants; and how these decisions can impact an acquisition, strategic investment, or assignment.
